    General Terms and Conditions

    1. Introduction

    Below you will find our General Terms and Conditions. These apply whenever you use or place an order via our website and contain important information for you as a buyer. Please read the General Terms and Conditions carefully. We also recommend saving or printing these terms so you can refer to them later.

    2. Definitions

    1. Becidor: located in ’s-Heerenberg, with an additional location in Boven-Leeuwen, registered with the Chamber of Commerce under registration number KvK 30272548, operating under the name Becidor.
    2. Website: the website of Becidor, accessible via www.becidor.nl, www.boomlooszadelbecidor.nl, and all associated subdomains.
    3. Customer: the natural person not acting in the exercise of a profession or business who enters into an Agreement with Becidor and/or has registered on the Website.
    4. Agreement: any arrangement or agreement between Becidor and the Customer, to which the General Terms and Conditions form an integral part.
    5. General Terms and Conditions: these General Terms and Conditions.

    3. Applicability of General Terms and Conditions

    1. These General Terms and Conditions apply to all offers, agreements, and deliveries from Becidor, unless expressly agreed otherwise in writing.
    2. If the Customer includes terms or conditions in their order, confirmation, or notification that deviate from or are not included in the General Terms and Conditions, these will only be binding on Becidor if and insofar as they have been explicitly accepted in writing by Becidor.

    4. Delivery Area

    1. Becidor delivers to all countries fully located in Europe. Delivery to countries partially or entirely outside Europe will only take place after consultation and written acceptance by Becidor.
    2. For almost all countries within Europe, transport costs and the free delivery threshold have been established. Current shipping costs can be found on the page https://www.boomlooszadelbecidor.nl/c-3474515/verzendkosten/
    3. For Albania, Kosovo, Macedonia, Malta, Moldova, Montenegro, Ukraine, San Marino, Vatican City, and Belarus, transport costs are not fixed. When a customer submits a request for these countries, Becidor will prepare a quote. The customer will then have the option to accept or reject the quote and proceed with the agreement. Becidor will only proceed with the execution of the agreement after this.
    4. For horse feed, the delivery area is limited to the Netherlands and Belgium. Items falling under this category are listed on the following page of the Website: https://www.boomlooszadelbecidor.nl/c-3383937/voeding/

    5. Prices and Information

    1. All prices listed on the Website and in other materials from Becidor are inclusive of VAT and other government-imposed taxes.
    2. Shipping costs are between €3.99 and €86.03 within the delivery area specified in Article 4. These costs can also be found on the following page of the Website: https://www.boomlooszadelbecidor.nl/c-3474515/verzendkosten/. Additionally, these costs will be displayed during the ordering process.
    3. The content of the Website has been compiled with the greatest care. However, Becidor cannot guarantee that all information on the website is always accurate and complete. All prices and other information on the Website and in other materials from Becidor are therefore subject to obvious programming and typographical errors.
    4. Becidor cannot be held responsible for (color) discrepancies due to screen quality.

    6. Formation of Agreement

    1. The Agreement is concluded at the moment the Customer accepts Becidor’s offer (by clicking the “Place Order” button) and meets the conditions set by Becidor.
    2. If the Customer accepts the offer electronically, Becidor will promptly confirm receipt of the acceptance of the offer electronically (confirmation email). The customer has the right to cancel the agreement (withdraw) within 30 calendar days of receiving the items.
    3. If it appears that incorrect information was provided by the Customer at the time of acceptance or in other ways when entering into the Agreement, Becidor has the right to fulfill its obligation only after receiving the correct information.

    7. Execution of Purchase Agreement

    1. As soon as Becidor receives the order, it will dispatch the products as soon as possible, taking into account the provisions in section 3 of this Article.
    2. Becidor is entitled to involve third parties in fulfilling the obligations arising from the Agreement.
    3. The Website clearly describes, in a timely manner before concluding the Agreement, how delivery will take place and within what timeframe the products will be delivered. If no delivery time has been agreed upon or mentioned, the products will be delivered within 30 days at the latest.
    4. If Becidor cannot deliver the products within the agreed timeframe, it will notify the Customer. The Customer can then agree to a new delivery date or opt to cancel the Agreement free of charge.
    5. Becidor advises the Customer to inspect the delivered products and report any defects discovered within a reasonable time, preferably in writing or by email. See the section on warranty and conformity for further details.
    6. Once the products to be delivered have been delivered to the specified delivery address, the risk for these products transfers to the Customer.

    6.1 Right of Withdrawal

    1. If the Customer is a natural person acting outside of their profession or business, the Customer has the right to cancel the distance agreement with Becidor within 30 calendar days after receiving the product, without giving any reason, free of charge. Only the direct costs of returning the product are at the Customer's expense. The Customer must bear the return costs themselves. Any costs paid by the Customer for shipping and payment of the product will be refunded upon return of the entire order.
    2. During the withdrawal period referred to in section 1, the Customer must handle the product and packaging with care. The Customer may only open the packaging and use the product to the extent necessary to determine the nature, characteristics, and functioning of the product. Products may be tried on but should not be used.
    3. The Customer can cancel the Agreement in accordance with section 1 of this Article by returning the product within the period specified in section 1, or by notifying Becidor within this period that they wish to withdraw from the purchase and will return the product (using the withdrawal form). Products can be returned to: Becidor, Ambachtstraat 2, 7041 GC, ‘s-Heerenberg, also see (return form).
    4. Amounts already paid by the Customer will be refunded as soon as possible, but no later than 14 days after the cancellation of the Agreement.
    5. The Website provides clear information, in a timely manner before concluding the Agreement, about the applicability of the right of withdrawal and any desired procedure.
    6. The right of withdrawal does not apply to: Products made by the entrepreneur according to the specifications of the consumer. This includes MY Barefoot, Grandeur, and Holu Horse (for custom production, not the standard assortment) products.

    6.2 Warranty and Conformity

    1. Becidor ensures that the products meet the Agreement, the specifications mentioned in the offer, the reasonable requirements of soundness and/or usability, and the applicable legal provisions and/or government regulations at the time the Agreement is concluded. If specifically agreed, Becidor also ensures that the product is suitable for use other than normal use.
    2. A warranty provided by Becidor, the manufacturer, or the importer does not affect the legal rights and claims the Customer already has under the Agreement and can invoke.
    3. If the delivered product does not meet the Agreement, the Customer must notify Becidor within a reasonable time after discovering the defect.
    4. If Becidor deems the complaint justified, the relevant products will be repaired, replaced, or reimbursed after consulting with the Customer. The maximum reimbursement equals the price paid by the Customer for the product. This Article does not preclude a claim for possible damages.

    7. Execution of Rental Agreement

    1. The following article applies when products included in the order contain the word TEST in the product name/title, for these products a rental agreement applies.
    2. Once Becidor receives the order, it will send the TEST package as soon as possible, taking into account the provisions in section 4 of this Article.
    3. Becidor is entitled to involve third parties in fulfilling the obligations arising from the Agreement.
    4. The Website clearly describes, in a timely manner before concluding the Agreement, how delivery will take place and within what timeframe the TEST package will be delivered, through an indication of the waiting time. An indication is not a fatal term.
    5. If Becidor cannot deliver the TEST package within the agreed timeframe, it will notify the Customer. The Customer can then agree to a new delivery date or opt to cancel the Agreement free of charge.
    6. Once the TEST package has been delivered to the specified address, the risk for the TEST package transfers to the Customer.
    7. Upon receipt, the rental period for the TEST package, as specified in the order, begins, with a maximum duration of five weeks. At this point, the right of withdrawal expires, but the possibility to shorten the rental period remains.
    8. Becidor advises the Customer to inspect the delivered TEST package and report any defects immediately, preferably in writing or by email.
    9. Use of the TEST package is entirely at the Customer's risk.
    10. At the end of the rental period, the Customer must return the TEST package in its entirety to Becidor, except for the Barefoot mini-, USG catalog, and purchase products.
    11. Once the returned TEST package has been delivered to the specified address, the risk for the TEST package transfers to Becidor.
    12. After receipt, Becidor will inspect the TEST package for any damage within 14 days. Damage not reported by the Customer as described in section 8 of this article will be charged to the Customer. Missing parts of the TEST package will also be charged to the Customer.
    13. If, after the end of the rental period, the tested package is purchased new on the Website by the Customer, the rental fee will be deducted from the order.

    8. Payment

    1. The Customer must make payments to Becidor according to the payment methods indicated in the ordering process and possibly on the Website. Becidor is free to choose the payment methods offered and these may change from time to time.

    9. Complaints Procedure

    1. If the Customer has a complaint about a product (as per the warranty and conformity section) and/or other aspects of Becidor's service, they can submit a complaint to Becidor by phone, email, or mail. See the contact details at the end of the General Terms and Conditions.
    2. Becidor will respond to the Customer’s complaint as soon as possible, but in any case within 14 days of receiving the complaint. If it is not yet possible to provide a substantive or final response, Becidor will acknowledge receipt of the complaint within 14 days and provide an indication of the timeframe in which a substantive or final response is expected.
    3. If the Customer is not satisfied with the handling of a complaint by Becidor, they can submit the dispute to the dispute resolution committee via the ODR platform. You can find the European dispute resolution committee via the ODR platform here: http://ec.europa.eu/consumers/odr/

    10. Personal Data

    1. Becidor processes the Customer's personal data carefully. Address, phone number, email, or other data will never be disclosed to third parties.
    2. Becidor has a privacy policy that explains how personal data is handled.

    11. Final Provisions

    1. Dutch law applies to the Agreement.
    2. Except as otherwise provided by mandatory law, all disputes arising from the Agreement will be submitted to the competent Dutch court in the district where Becidor is located.
    3. If a provision in these General Terms and Conditions is found to be invalid, this does not affect the validity of the entire General Terms and Conditions. In such cases, the parties will establish one or more new provisions to replace the invalid provision, aiming to reflect the original intent of the provision as closely as legally possible.
    4. "Written" communication in these General Terms and Conditions also includes communication by email and fax, provided the identity of the sender and the integrity of the email are sufficiently established.
